Property ownership by Foreigners in Indonesia (Bilingual)

The new regulations issued by the President as outlined in Government Regulation No. 103 in 2015, which effective on 28 December 2015, regarding the Housing Ownership by foreigners domiciled in Indonesia, and have the Residence Permit in Indonesia, aims to provide legal certainty for a Foreigners in possession dwelling house which has changed the rules of the regulation no. 41 year 1996.

Foreigners (not Local citizen/WNI) who has a residence permit in Indonesia have the right to be able to buy property in Indonesia in the form of a single house or apartment house with the Right to Use for 30 years in which these rights can be extended for another 20 years. And after 20 years, the right can be renewing for the Rights of Use for another 30 years (art. 6.7).

This right can be passed on to the Foreign whom also has a residence permit in Indonesia or qualified (art.2).

For the local citizen/WNI who is married to a foreigner, have the same rights as the citizen to home ownership. But must have a certificate of prenuptial Agreement regarding separation of wealth, confirmed before the notary (art3).

Agreement between foreigners who have the right to use with the land rights owner must be recorded in the land book and certificate of the Rights on Land. (art. 9).

If the foreigners who own the right to Use is no longer domiciled in Indonesia, then the property should be released within a period of 1 year, or if the release time period passes, it will be in the auction by the state if it was built on state land, where the results of the auction will be given to the previous owner of the rights, which is the Foreigner. But if the house is built on the land of the owner of the land (WNI) then the Property will be transfer back to the owner of the land (art.10).

 

Kepemilikan Properti oleh orang Asing di Indonesia

Peraturan yang baru dikeluarkan Presiden RI yang dituangkan dalam Peraturan Pemerintah RI no 103 tahun 2015, yang mulai berlaku tanggal 28 December 2015 lalu, tentang Pemilikan Rumah Tempat Tinggal atau hunian orang asing yang berkedudukan di Indonesia, bertujuan untuk memberikan kepastian hukum untuk Orang asing dalam kepemilikan rumah tempat tinggal yang mana peraturan ini telah mengganti peraturan no. 41 th 1996.

Orang Asing (bukan WNI) yang memiliki ijin tinggal di Indonesia memiliki hak untuk bisa membeli property di Indonesia dalam bentuk rumah ataupun Rumah susun dengan hak Pakai selama 30 tahun yang mana hak tersebut bisa diperpanjang selama 20 tahun lagi. Dan jika setelah 20 tahun, maka hak Pakai tersebut bisa diperpanjang lagi selama 30 tahun ( ps. 6,7).

Hak ini bisa diwariskan ke orang Asing yang juga memiliki ijin tinggal di Indonesia atau yang memenuhi syarat ( ps 2).

Bagi WNI yang menikah dengan orang asing, memiliki hak sama dengan WNI untuk kepemilikan rumah. Tetapi harus memiliki surat keterangan Pisah harta yang dikukuhkan dihadapan notaris (ps3).

Perjanjian antara orang asing yg memiliki hak pakai dengan pemilik hak atas tanah harus tercatat dalam buku tanah dan sertifikat PPAT yang bersangkutan (ps 9).

Jika WNA yang memiliki hak Pakai tersebut tidak lagi berkedudukan di Indonesia, maka property tersebut harus segera dilepas dalam jangka waktu 1 (satu) tahun. Apabila jangka waktu 1 (satu) tahun tersebut lewat, maka rumah tersebut akan di lelang oleh negara jika didirikan diatas tanah Negara yang mana hasil lelang akan diberikan kepada pemilik hak, dalam hal ini Orang asing, Atau menjadi milik dari pemilik hak atas tanah yang mana dibangun rumah diatasnya ( ps 10).
